1. Purpose

These terms and conditions of sale aim to define the contractual relationship between Intelligent Sensory Concept SA or BIOLUX and the buyer, and the conditions applicable to any purchase made through the website www.biolux.ch or www.bioluxgroup.com . These two websites are identical and can therefore be considered "the BIOLUX website." Purchasing a product through this website implies the buyer's unreserved acceptance of these terms and conditions of sale, which the buyer acknowledges having read prior to placing their order.

By placing an order with BIOLUX, the buyer declares that they have full legal capacity. Minors or persons under guardianship must, prior to any purchase, provide written authorization from their legal representative or guardian before placing an order.

Intelligent Sensory Concept SA reserves the right to modify these terms and conditions of sale at any time, in order to comply with any new regulations or to improve the use of its website. Therefore, the applicable terms and conditions will be those in effect on the date the order is placed by the buyer.

2. Products

The products offered are those listed on the BIOLUX website, www.biolux.ch or www.bioluxgroup.com , subject to availability. BIOLUX reserves the right to modify its product range at any time. Each product is presented on the website with a description outlining its main characteristics. Photographs are as accurate as possible but are not contractually binding.

3. Prices

The prices listed on the website www.biolux.ch are in Swiss Francs (CHF), inclusive of all taxes (VAT included), based on the VAT rate applicable on the day of the order. The prices listed on the website www.bioluxgroup.com are in Euros (€), inclusive of all taxes (VAT included), based on the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. BIOLUX reserves the right to modify its prices at any time; however, the price listed in the catalog on the day of the order will be the only price applicable to the buyer. The prices indicated do not include delivery charges, which are billed in addition to the price of the products purchased, according to the total order amount. A flat-rate shipping fee will be charged to the buyer as follows:

Participation in standard delivery costs (postpac Economy): CHF 15.00
including VAT and guarantee on the package.

4. Order and conclusion of the contract

BIOLUX only accepts orders from buyers domiciled in Switzerland or Europe.

BIOLUX reserves the right to cancel any order from a customer with whom there is a dispute regarding payment for a previous order.

BIOLUX may unilaterally refuse to enter into a contract with the buyer.

In the case of a first order on our website, the creation of a customer account, or the entry of contact details for an order without creating a customer account,

5. Payment terms

By placing an order with BIOLUX, the buyer expressly authorizes BIOLUX to verify their creditworthiness with third-party organizations.

7. Delivery

Deliveries within Switzerland are handled by Swiss Post, and deliveries within France are handled by a carrier (such as Colissimo, Chronopost, UPS, DHL, or FedEx). Delivery times indicated in these terms and conditions of sale are estimates only and do not constitute a binding commitment. Failure to meet a delivery deadline does not entitle the Buyer to any compensation from BIOLUX

Delivery time for standard shipping: 3-4 business days

Delivery time for express shipping: 1-2 business days

After order confirmation and subject to full payment of the price of the products ordered, BIOLUX undertakes to process the order within one business day.
All products specified in orders placed with BIOLUX are intended for the personal use of the customers or the recipients whose name appears on the delivery address.

Where applicable, the customer agrees to pay upon receipt all present and future taxes, duties, levies, and other charges due in connection with the delivery of the products themselves; BIOLUX shall not be held jointly liable in this respect under any circumstances.
Customers and recipients of the products are prohibited from reselling the products, either partially or in full.

Our rates and delivery terms are available in the “Shipping and Deliveries” section

https://biolux.ch/envois-et-livraisons.html

7.1 Delivery in Switzerland:
Upon receipt of the ordered products, the customer or recipient must verify that the delivered goods are functioning correctly and familiarize themselves with the operating instructions provided. If one or more of the ordered products are missing or damaged, the customer or recipient must make any necessary reservations with the carrier at the time of delivery. In the case of visible defects, the customer has the right to return the goods under the conditions stipulated in the product's operating instructions.

Due to product availability, an order may be delivered to the customer in several installments. If the customer wishes to have the ordered products delivered to two separate addresses, they must place two separate orders.

7.2 Delivery in France:

In the case of delivery to a collection point, the Customer is notified of the arrival of their parcel by email. Upon collection, the Customer is asked to check the general condition of the parcel before signing and, in case of damage, to refuse delivery. However, if the merchant refuses to open the parcel at the collection point, the Customer is asked to report the incident to Customer Service within 72 hours of receiving the parcel by email, indicating the relevant order number and attaching a precise description of the condition of the parcel or damaged product.
Parcels are available to the recipient for a period of 10 to 14 days, depending on the collection point. Parcels not collected after this period are returned to the Seller.
If the order is returned to the Seller due to the Customer's failure to collect it within the specified timeframe, the order will be canceled and refunded to the Customer. In this case, the return shipping costs will be deducted from the amount refunded to the Customer (the amount deducted will be the same as the delivery costs due for the order not collected).

If delivery has not been made within 30 days of the order date, unless otherwise agreed between the buyer and BIOLUX, the buyer may set an additional deadline appropriate to the circumstances to allow for delivery. If, even after this final deadline, BIOLUX still has not delivered the goods, the buyer has the right to terminate the contract.

8. Retention of Title

BIOLUX retains full ownership of the products sold until full payment is received from the buyer.

9. Product verification and risk transfer

The buyer must inspect the products within 3 days of receipt and must immediately inform BIOLUX of any defects or damage. If the buyer does not notify BIOLUX within this timeframe, the products will be deemed to have been received in good condition.

The transfer of risk passes to the buyer upon receipt of the products.

If the buyer returns the products, they bear the risks until BIOLUX receives the goods.

10. Warranty

All products sold by BIOLUX are guaranteed for 2 years. The guarantee takes effect on the date of delivery and is evidenced by the invoice accompanying the shipment.

Any product found to be defective must be returned to BIOLUX for analysis and will be replaced with a new product.

11. Right of withdrawal

The customer has a 14-day cooling-off period from the date of receipt of the ordered products (the day of receipt is not included in this period, which begins the following day). If this cooling-off period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.

The period mentioned in the first paragraph runs from the day of receipt of the goods by the consumer or a third party, other than the carrier, designated by him, for contracts for the sale of goods.

The customer exercises their right of withdrawal by informing BIOLUX of their decision to withdraw by sending, before the expiry of the period provided, an unambiguous statement expressing their wish to withdraw to the following email address: This email address is being protected from spambots. You must enable JavaScript to view it. Or This email address is being protected from spambots. You must enable JavaScript to view it.

The customer must return the products, at their sole expense, to the address: within 14 days of communicating their decision to withdraw, in their original packaging, unused and in perfect condition, without any trace or mark, with the labels and all possible accessories.

The customer may be held liable for any diminished value of the products resulting from handling other than what is necessary to establish their nature, characteristics, and proper functioning.

If a return involves multiple products and the customer does not return all of them, BIOLUX will deduct the price of the missing products from the refund amount.

BIOLUX undertakes to reimburse the customer for all sums paid, including delivery charges, without undue delay, within 14 days of being informed of the customer's decision to withdraw. However, BIOLUX reserves the right to postpone this reimbursement until the goods have been effectively received or until the customer has provided proof of shipment of these goods, whichever occurs first.

BIOLUX makes the refund using the same payment method used by the customer for the initial transaction, unless the customer expressly agrees to use another payment method and provided that the refund does not incur any costs for the customer.

12. Intellectual Property

All elements of the website www.biolux.ch or www.bioluxgroup.com are and remain the exclusive intellectual property of BIOLUX. Without BIOLUX's permission, no one is authorized to reproduce, exploit, or use any element of the website, whether in the form of photos, logos, visuals, or text, in any way whatsoever.

13. Protection of personal data

Personal data is treated confidentially by BIOLUX, in accordance with data protection legislation. BIOLUX does not transmit any data to unauthorized third parties. You will find more information on this subject in the following section: Data Protection Declaration.

The research

BioLux

RESEARCH

Since its creation in 2007, research and collaboration with experienced researchers has been at the heart of Biolux's DNA.
  • 10 years of partnership INSERM - INM

An exclusive collaboration signed with an INSERM team based at the Montpellier Neuroscience Institute (INM) has enabled Biolux to understand the mechanisms of action of photomodulation.
  • Biolux's expertise

The multidisciplinary expertise of our R&D team has enabled us to validate the effectiveness of our treatments at different scales.
  • From research to the human

Biolux medical progress begins with basic research followed by translational and clinical research before finally becoming available to humans.
[triangle-down]
4 fundamental axes
Research and development programs in photomodulation have been established along 4 major axes around which all protocols are developed:
  • Healing
  • Inflammation
  • Regeneration
  • Pain
in vitro

Various investigations have highlighted the role of photomodulation in cell migration, proliferation and differentiation, as well as in the regulation of inflammation.

Published article:  Validation of the action of LEDs on the neuritic growth velocity of sensory neurons : under axotomy conditions, the neuritic growth velocity obtained after LED stimulation reached a threshold never equaled in the articles available in the literature.

In vivo level

Transition before the application of stimulation protocols in clinical practice; the investigations put in place made it possible to validate on more integrated models the different results obtained at the cellular level.

Translational level

Transfer of knowledge and technology into therapeutic application: creation of professional and home care devices for clinical use.

Clinical level

A large-scale international clinical study, conducted in collaboration with a Brazilian team, was implemented to evaluate the effect of photomodulation on abdominoplasty scars. This study definitively validates the effect of Biolux technology across the four key areas involved in the post-surgical healing process.

A constant investment

Continuous improvement and innovation of therapeutic possibilities commits Biolux to continuing to invest in R&D :

by developing new academic and private partnerships (collaboration with renowned doctors and clinics)
by relying on the multidisciplinary nature of its R&D team by offering new functionalities of evolving and ever more innovative devices.
